  • How to use the Records

    Researchers should note that this series is a sample only of the case files of the Office of the Public Solicitor. This series is made up of a sample of the files in VPRS 5272 Case Files and Units 1 to 390 of VPRS 10001 Case Files. Those records were sampled according to PROS 91/2 Records Disposal Schedule for Records of the Legal Aid Commission of Victoria under which case files are sentenced as Temporary, but that a sample of 1 file per 1000 should be retained as Permanent.

  • Function / Content
    The function of the Office of the Public Solicitor was to provide legal aid to paupers or persons able to satisfy a stringent means test as provided for in the Poor Persons Legal Assistance Act 1927. Representation was available for certain criminal and civil proceedings, including matrimonial causes, until the passing of the Legal Aid Act 1969 when responsibility for legal aid in civil and matrimonial cases passed to the Legal Aid Committee.

    The series in custody consists of a sample of the case files of the Office of the Public Solicitor dated from 1956 to 1982.

    Files contain an application from the prospective client for legal assistance and a decision regarding the application with cases to do with criminal, civil or matrimonial matters. The file may also contain correspondence regarding representation, particularly in court. Barristers and solicitors claims may also be included as is a report of the case. Files may contain copies of evidence given and/or transcripts of the cases or the judgment as, for example a divorce decree nisi. From c1965 most new cases with respect to civil and matrimonial matters were referred to the Legal Aid Committee with the Public Solicitor continuing to provide aid in criminal matters.

    VPRS 12177/P1 Register of Criminal Proceedings (Legal Aid) provides a summary record of criminal matters in which the Office of the Public Solicitor provided legal assistance. VPRS 12176/P1 Register of Applications for Legal Aid provides evidence for applications for legal aid in civil, criminal and matrimonial matters.
