  • How to use the Records
    The index which provides access to records in this series has not been transferred to Public Record Office custody. If the registration number of the application being researched is not known, all entries in the volume of the relevant date range must be examined.

  • Function / Content
    This series registered and summarised action by the Public Solicitor's Office in relation to legal aid provided in criminal matters. For every application for which legal aid had been approved, the register recorded:

    the date of entry

    the registration number (in a sequence which recommenced at one at the start of every new year)

    the name of the accused

    the dates and places of court hearings

    the charges

    the verdict and sentence or order

    counsel representing

    fees

    Public Solicitor's Office and Crown Law Office file numbers (respectively, VPRS 5272 Public Solicitor's Office Case Files and VPRS 266 Inward Registered Correspondence) and

    remarks (generally cross references to earlier and later entries in relation to the same matter).

  • Recordkeeping System
    When the Public Solicitor's Office received an application for legal aid the application was recorded in a register. Entries made in the register as a case progressed were

    the date received and the registration number (the registration number became the file number in VPRS 5272 Public Solicitor's Office Case Files - see below)

    the name and address of the applicant

    the offence charged with

    the date on which the application was forwarded to the Attorney-General's Department

    whether the application was recommended or not

    the initials of the Public Solicitor's Office investigating officer

    remarks

    whether the Attorney-General's department approved the application or not

    the Crown Law Office file number (in VPRS 266 Inward Registered Correspondence - see below) and

    for approved applications, the register volume, page number and entry number in VPRS 12177 Register of Criminal Proceedings (Legal Aid Cases) (this series).

    (The register has not been transferred to the Public Record Office and has not been seen in the agency since September 1999.)

    A card was then created in a nominal index. Information added to the card as the case progressed included, in addition to the information recorded in the register described above:
    co-accused
    the date of means assessment
    deposition number
    dates of interviews, preparation of brief and despatch of brief to counsel
    a summary of the applicant's personal details
    the plea
    the Judge and
    accounting information.

    (The nominal index has not been transferred to Public Record Office custody.)

    A case file was created in VPRS 5272 Public Solicitor's Office Case Files and the application forwarded to the Attorney-General's Department (Crown Law Office - CLO) with a recommendation on whether or not to approve legal aid. The Attorney-General's department created a file in VPRS 266 Inward Registered Correspondence, recorded the decision to approve or not approve the application on that file, and advised the Public Solicitor's Office of the decision.

    On receipt of the Attorney-General's Department's advice that legal aid had been approved in relation to a criminal matter the Public Solicitor's Office made an entry in this series (VPRS 12177). If the matter required more than one hearing a new entry was made for each occasion, with related entries cross referenced in the Remarks column.

    In summary, detailed records of action taken by the Public Solicitor's Office in relation to assisted criminal matters were made in VPRS 5272; this series (VPRS 12177) and the register and index which have not been transferred to the Public Record Office summarised and provided access to those records.

    VPRS 12177 ended in 1981 when the Public Solicitor's Office merged with VA 878 Legal Aid Committee and VA 4150 Australian Legal Aid Office to form VA 877 Legal Aid Commission.
