  • How to use the Records
    This series may be used to access information on adoptions from VPRS 11683 Adopted Children Register and VPRS 11682 Adoption Orders for the period 1928 to 1967.

    Get the Adopted Children Registration Number (ACR Number) by using this Name Index.

    Refer to the Consignment Details for VPRS 11683 and VPRS 11682 and call up the appropriate unit.

  • Function / Content
    The adoption of children was first regulated by the Adoption of Children Act 1928 (No 3605). This Act established adoption as a legal transfer of custody and of parental responsibility and gave responsibility for making adoption orders to the courts. Prior to this time, adoptions were informal arrangements often made by private infants homes.

    Under the 1928 Act an adoption application could be heard by the Supreme Court, County Court or Court of Petty Sessions. The choice of court depended upon the circumstances of the case and the wishes of the parties. The Adoption of Children Act 1958 (No.6192) removed the jurisdiction of the Court of Petty Sessions to grant adoption orders. Since that time the County and Supreme Courts have had the power to grant adoption orders, although in practice most have been granted by the County Court.

    Under section 17 (1) of the Adoption of Children Act 1928 (No 3605) and the subsequent adoption acts, the Government Statist was required to establish and maintain in his office at Melbourne a register to be called the "Adopted Children Register, (this series VPRS 11683) in which entries were made as directed by adoption orders.

    Section 17 (2) required every adoption order to contain a direction to the Government Statist to make in the Adopted Children Register an entry recording the adoption in the form set out in the Schedule to the Act.

    The adoption order further directed the Government Statist to annotate the birth entries in the Birth Register with the word "Adopted".

    As part of the recordkeeping system a name index was created (as required by section 17(6) of the Act.

    This series comprises typed copy of index books created to provide access to adoptions registered during the period 1928 to 1967. The adoptions registered from 1928 to 1967 were initially indexed on cards that were destroyed once the index books were written up. (Refer to VPRS 11685 for the original index books)

    This series provides access to adoptions by surname of the adoptive parents and by surname of natural parents.

    The information recorded in the index books includes:

    - Name of Adopted Child (name as stated in the adoption order)
    - Name and address of adopted and natural parents
    - Registration number of the Adoption Order

    Related Court Records

    The Registry obtained the original court records (including Courts of Petty Sessions, Melbourne County Court and the Supreme Court) in 1988, following the proclamation of Section 8 of the Adoption (Amendment) Act 1987 (No.67).

    The court records were used by the Registry to obtain sufficient information to prepare more detailed birth certificates for adopted persons.

  • Recordkeeping System
    Following each adoption, the Court ordering the adoption provided the Registry with an Adoption Order. These adoptions orders (VPRS 11682) from the Court advised the Registry of the adoption and gave sufficient details of the adoption for the Registry to register it in the Adopted Children Register, VPRS11683, and to cancel the original birth registration entry from the Registers of Birth VPRS 8341.

    The Adoption Order is the only link between the Registry's adoption records and the court adoption records. The court file reference number is recorded on the adoption orders.

    The Adoption Orders (VPRS 11682) from the courts are stamped with date received. A memo slip with details of the original birth entry obtained from the Register VPRS 8341 and Indexes of Births VPRS 7290/P3 is attached to the adoption order. The original birth entry is stamped "Adopted" and the name of the court and place of adoption are noted in the entry. A new entry under the new adopted name is made in the year of birth in the Register of Births VPRS 8341.

    Registration and Indexing of Adoptions

    Adoption registration is initiated on receipt of adoption orders from the court. The Adoption Orders are numbered sequentially and filed in Adoption Registration Number (ACR) in VPRS 11682. A new Schedule in accordance with Section 17 of the Act is typed from the details provided from the Adoption Order and bound in the Adopted Children Register (VPRS 11683). This Register VPRS 11683 is a separate series of volumes from the Birth Registers VPRS 8341.

    During the registration process name index cards and name index books were created.

    1929 to 1968

    Initially different colour Index cards were written up. The data was subsequently transferred to volumes of name indexes (Handwritten, VPRS 11685) The name index cards for the period 1929 to 1967 were destroyed. In 1968 a typed copy (this series) of the name index was created.
